I’m Christopher Washington. Today’s guest is <b><strong>Daniel Kennedy</strong></b>, an attorney with Hogan Attorneys in Hammond, Louisiana. After beginning his career in indigent defense, Daniel represented Jason in a case where the defense argued he acted in self-defense while protecting himself and his son.</p><p><b><strong>DANIEL:</strong></b><br />The facts and the law are often more complicated than that. You have to understand what happened, what the person intended, and the circumstances around it. The work means seeing the humanity and complexity in people’s lives.</p><p><b><strong>CHRISTOPHER:</strong></b><br />What did the jury need to know about Jason?</p><p><b><strong>DANIEL:</strong></b><br />He was devoted to his family, especially his son Hunter, who became quadriplegic after an accident. Jason worked to help Hunter continue doing the things he loved. But the family also had a difficult history, including alcohol abuse and evidence of violence.</p><p><b><strong>CHRISTOPHER:</strong></b><br />Jason admitted shooting Christy. Why did the timeline matter?</p><p><b><strong>DANIEL:</strong></b><br />Because the defense believed the events leading up to the shooting helped explain what happened. The night before, Hunter texted Jason for help because Christy was passed out. Jason went to the house but couldn’t get inside. The next day, after getting a van for Hunter, Jason returned and found his son still in the same soiled clothes. He tried to lift Hunter, fell, and hurt himself. We used phone records and messages to help show the jury that larger context.</p><p><b><strong>CHRISTOPHER:</strong></b><br />What did you find in Jason’s confession?</p><p><b><strong>DANIEL:</strong></b><br />It was damaging, but it also contained details that supported the defense. You have to listen closely and repeatedly. I clipped key moments so the jury could hear them without having to search through a long interview.</p><p><b><strong>CHRISTOPHER:</strong></b><br />You also questioned Hunter, who testified for the state. How did you handle that?</p><p><b><strong>DANIEL:</strong></b><br />It was one of the hardest parts of the trial. I needed to present the evidence without making the jury feel I was attacking him.
